MunchEm Privacy Policy

 Protecting the privacy of your personal information you share with us is crucial to MunchEm, Inc. (the “Company”). To ensure that your personal information is maintained securely, we have developed the following Privacy Policy. This document describes the type of information we collect from you and the Company's practices with respect to the gathering and disseminating of information about, you (the “Service”). This Privacy Policy was established within the context, and applies to the use, of our services (MunchEm Website, Munchem App, Custom Websites or Apps created by us), features, content or applications offered by the Company, and any other websites or apps operated, hosted, or maintained by MunchEm. Our Privacy Policy is applicable to not only the use of the MunchEm website and Service, but also all interactions between you and the Company, as there is the possibility that during such interaction, we may acquire your personal information. All users, end-users, and third parties are notified that such policies are applicable only to the interaction between MunchEm and the individual or customer. Any Customer site, application, information, data, or collection of such is governed by that Customer’s policies and the agreement between the Customer and the individual User. MunchEm is not responsible or liable for any Customer or User collection of data through the Service.

1. How And When Does the Company Collect Non-Public Personal Information?

In the course of providing the Service, we may collect and maintain certain nonpublic personal information as set forth within this Privacy Policy.

We do not collect personal information (such as names, addresses, phone numbers, email addresses or credit card numbers) about you except when you specifically provide such information on a voluntary basis, or as necessary to perform various transactions. Some examples of personal information collected during your utilization of our services are your username, password, first and last name, address, date of birth, phone number and email address. Such information is illustrative of some types of personal information collected, and is not meant to be exhaustive.

Your personal information may be collected as you:
• Become a registered user of the MunchEm Website or App
• Sign-up or Order Food from participating restaurants
• Participate in surveys, reviews, special promotions or other offerings.

MUNCHEM IS NOT RESPONSIBLE, NOR DOES MUNCHEM REGULATE, PERSONAL INFORMATION COLLECTED BY ITS CUSTOMERS OR END USERS IN THE PERFORMANCE OF THEIR SERVICES THROUGH THE MUNCHEM SERVICE. SUCH COLLECTION IS THE SOLE RESPONSIBILITY OF THE COLLECTOR, BE IT AN END USER OR CUSTOMER, AND IS GOVERNED BY THE POLICIES SET FORTH BY SUCH COLLECTOR. BY YOUR USE OF THE SERVICE YOU AGREE TO HOLD MUNCHEM HARMLESS FROM ALL POTENTIAL COLLECTION OF INFORMATION BY ANY CUSTOMER OR USER OF THE SERVICE OUTSIDE THE CONTROL OF MUNCHEM.

2. How and When Does the Company Use Non-Public Personal Information?

When you visit our Website, we may gather information about the use of your computer that we aggregate with similar information collected from other visitor's computers, for statistical and other purposes (see “Aggregate Information” described in Section 6 below).

Please note that when you leave this Site, whether via a link provided by us or otherwise, you may enter a site owned and controlled by a third party (“Third Party Sites”). Accordingly, this policy does not apply to any information that you share on Third Party Sites. We may occasionally contact you, mostly by email, to notify you of information that might affect your event experience, cancellations, or errors in your order. Additionally, we may contact you regarding offerings of future events, products, or services that may be of interest to you. You can unsubscribe at any time by logging in to your account and uncheck all unwanted emails from your Account Preferences.

In certain instances, you may consent to share personal information via an “opt-in” or “opt-out” mechanism under Account Preferences section of Your Account. Only upon receiving your consent via such mechanism, MunchEm will disclose your personal information to third parties.

MunchEm may share personal information to trusted third parties, affiliates, or agents who assist us in operating our Site, conducting our business, or the provision of the Services to you. These third parties or agents may use your personal information only to the extent necessary to perform the services they agreed to provide to MunchEm, and are expected to provide a comparable level of protection and confidentiality of your personal information.

MunchEm uses Paypal or another third-party service provider to manage credit card processing. To facilitate MunchEm’s global operations, we may transfer and access Customers Data and personal information from around the world, including the United States. This Privacy Statement will be in force even if MunchEm transfers such data or information to other countries.

MunchEm may release your information if, at our sole discretion, we believe the release of your personal information is necessary to (a) comply with a legal obligation such as a court order or subpoena, (b) protect and defend the rights or property of MunchEm, (c) protect and defend the rights, property or safety of others, or (d) to protect against any legal liability. Additionally, your personal information may be shared in the event of a business transfer.

3. Customer and Third Party Service Provider Use of Information

Services and applications provided by individual Customers and Users of the MunchEm Service are not subject to the provisions of this Privacy Policy, which means that they may use your personal information for purposes other than what is set forth within this policy. When you use a Customer or Individual User’s application, you should read and become familiar with their privacy policies of the specific user application. The Company has no control over the use of your personal information by any Customer, User, or Third Party over whom we have no control or authority of and you agree that we are not liable for any use of your personal information by any such individual. If you have special preferences concerning use of your personal information by an individual user or customer you must communicate such preferences directly to them.

4. Opting-out, Correcting and Updating Your Information

MunchEm utilizes Email and Phone as a vital and primary communication channel with registered users of this Site. By providing us with your Email address and phone number, you grant to MunchEm (and its service providers) permission to communicate with you via Email or phone for any purposes MunchEm determines to be relevant to your use of their services or your relationship with MunchEm including, but not limited to, system and service messages, product updates, service announcements and other marketing messages. You may opt out of receiving any marketing messages that we may send to you.

Users who do not wish to receive marketing and non-transactional Emails are requested to login in to the Account in MunchEm and use Account Preferences to manage their preferences. Users experiencing any problems logging in their account online can contact MunchEm at the given contact information below. Users cannot un-subscribe from system or service messages, which contain important information about service notices and responsibilities. MunchEm occasionally communicates with its users via Email/Push Notifications to provide information about requested services and regarding issues related to their account.

5. How Long Is Your Personal Information Retained?

We will retain your information as long as you maintain your account is active with us.

6. What Is “Aggregate Information” And What Does the Company Do With It?

Typically, as visitors browse our Website, our computers automatically collect information related to how certain features of our Website are used, the geographic region our visitors are contacting us from, and how many people visit our Website at any given time. We only use this information in the aggregate, which means that we only derive meaning from the sum of all such information gathered for a period of time and accordingly, we refer to this information as “Aggregate Information”. Aggregate Information includes, but is not limited to, your computer's (i) Internet browser type (e.g., Microsoft Internet Explorer 5.5), (ii) IP address, (iii) resolution settings, (iv) platform type, and (v) originating URLs of referring web pages. We use Aggregate Information to (a) help diagnose problems with our computers, (b) administer our Website, (c) share certain generalized demographic information with Individual user or customer applications and our advertising partners about visitors of our Website, and (d) provide our advertising partners with information regarding which visitors saw and clicked on certain advertisements on our Website. Aggregate Information does not contain any personal information of any of our Website visitors

7. What Are “Cookies”, Web Beacons, and IP Addresses, And How Does the Company Use Them?

Types of Cookies

Required Cookies. Required cookies enable you to navigate the Company’s Website and Apps and use its features, such as accessing secure areas of the Websites and Apps and using Services. If you have chosen to identify yourself, the Company uses cookies containing encrypted information to allow the Company to uniquely identify you. Each time you log into the Service, App, or Website, a cookie containing an encrypted, unique identifier that is tied to your account is placed on your browser. These cookies allow the Company to uniquely identify you when you are logged into the Services and to process your online transactions and requests.

Performance Cookies. These cookies do not collect information that individually identifies a Visitor. All information these cookies collect is aggregated and remains anonymous. It is only used to improve how the Company’s Web site functions. From time-to-time, MunchEm engages third parties to track and analyze usage and volume of statistical information from visitors to the Company’s Web sites.

Functionality Cookies. Functionality cookies allow the Company’s Web sites to remember information you have entered or choices you make (such as username, language, or your region) and provide enhanced, more personal features.  These cookies also enable you to optimize your use of the Website, Apps, or Services after logging in. These cookies can also remember changes you have made to text size, fonts and other parts of web pages that you can customize.

Targeting or Advertising Cookies. From time-to-time, MunchEm engages third parties to track and analyze usage and volume statistical information from individuals who visit the Company’s Web sites.  MunchEm sometimes uses cookies delivered by third parties to track the performance of Company advertisements.  For example, these cookies remember which browsers have visited the Company’s Web sites. The information provided to third parties exclude personal information, but this information may be re-associated with personal information after the Company receives it.

MunchEm also contracts with third-party advertising networks that collect IP addresses and other information from Web beacons (see below) on the Company’s Web sites, Apps, and Services from emails, and on third-party Web sites. Ad networks follow your online activities over time by collecting Web Site Navigational Information through automated means, including through the use of cookies. They use this information to provide advertisements about products and services customized to your interests. You may see these advertisements on other Web sites too. This process also helps us validate the effectiveness of our marketing strategies.

Web Beacons
MunchEm uses Web beacons alone or in conjunction with cookies to compile information about Customers and Visitors’ usage of the Company’s Web sites, Apps, Services, and interaction with emails from the Company. Web beacons are clear electronic images that can recognize certain types of information on your computer, such as cookies, when you viewed a particular Web site tied to the Web beacon, and a description of a Web site linked to the Web beacon.

IP Addresses
When you visit the MunchEm App, Web sites, or utilize our Services, the Company collects your Internet Protocol (“IP”) addresses to track and aggregate non-personal information. MunchEm also collects IP addresses from Customers when they log into the Services as part of the Company’s “Identity Confirmation” and “IP Range Restrictions” security features.

8. Data Quality and Security Statement

MunchEm takes reasonable security measures to protect your personal information against unauthorized access, alteration, and disclosure of data. Our electronic security measures are complemented by the physical security of our facilities and limited access to certain critical areas, such as our computer locations. Access and use of personal information is restricted to employees, third parties or agents on a need to know basis only. These individuals are bound by confidentiality obligations with penalties specified for any breach of such obligations, and our management team and its engineers regularly review and update the integrity of this Site and the security of your Information. However, because of the increasing sophistication of computer hackers and others who would seek to invade our computer systems for the purpose of stealing information, damaging our systems or denying our systems' ability to operate effectively to safeguard personal and financial information as intended, we make no guarantees as to the security of personal or financial information in our possession or the impenetrability of our computer systems under unusual circumstances or our computer system's resilience to future sophisticated attacks. MunchEm also, cannot safeguard any data stored on your own personal computer, or any public computer upon which you might elect to access this Site.

9. Public forums, refer a friend, and customer testimonials

MunchEm, or its Customers, may provide bulletin boards, forums, blogs, or chat rooms on the Company’s Web sites. Any personal information you choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages. MunchEm is not responsible for the personal information you choose to submit on these forums.

Customers and Visitors may elect to use the Company’s referral program to inform friends about the Company’s Web sites. When using the referral program, the Company requests the friend’s name and email address. MunchEm will automatically send the friend a one-time email inviting them to visit the Company’s Web sites. MunchEm does not store this information.

MunchEm posts a list of Customers and testimonials on the Company’s Web sites that contain information such as Customer names and titles.

10. When Might Information Be Disclosed As A Matter Of Law?

We may disclose non-public personal information to unrelated parties in special cases when we have reason to believe that that disclosure is necessary to identify, contact, or bring legal action against a person or persons who may be causing injury to, or interference with, the rights or property of the Company Services (including our Websites and Apps), computer users accessing our Website, or any third party. In addition, we may disclose information about individuals who access our Website to law enforcement agencies, judicial or government authorities, or to other individuals or entities in response to subpoenas, court orders, or other legal processes.

11. Links To / From Other Sites 

The Service, our customer or individual user services or applications may contain links to other Internet websites which we do not operate and, conversely, other Internet websites may contain links to our Website. We are not aware of and are not responsible for the privacy policies, practices, or content of such other external websites. We recommend visitors to read and become familiar with the privacy policies maintained by such other websites.

12. Information of Minors & Children. 

We do not target our Website or our products or merchandise for sale on our Website to children, and our Website does not seek to collect contact information from children under the age of 13. However, should we become aware that a child under the age of 13 has provided us with personal information; MunchEm will take the necessary steps to remove such information and terminate the child’s account. 

If you are under the age of 13, please do not, submit any personal information to our Website, or ask us to email you. If you are under the age of 18, you should get permission from a parent or guardian before you email our Website, contact our Website, attempt to use our Website, submit information to our Website, or ask us to email you.

14. Changes to Privacy Policy.

 MunchEm reserves the right to modify this Privacy Policy from time to time. The most current version of the policy will govern our use of your personal information. In the even that MunchEm, at its sole discretion, determines that updates to the Privacy Policy constitute a material change, we may inform you of such changes in a notice published via the Services or send an email to the email address associated with your User account. Notwithstanding the foregoing, MunchEm is under no obligation to notify a User regarding changes to this policy. Users should periodically visit this page to review the then current Policy to which you are bound.
